PLEASER READ CAREFULLY BEFORE USING/ATTENDING OUR ONLINE YOGA CLASSES

International Yoga Academy Online Classes (“IYA”) are owned and operated by International Yoga Academy Limited (“IYA”), by accessing the content, you accept and agree to be bound by the terms and conditions of use of the IYA in their entirety without any modification whatsoever. By accessing the IYA, you agree to be bound by all the Terms and Conditions. You are not permitted to use IYA if you do not accept any Terms and Conditions. The Terms and Conditions may be periodically amended without notice from IYA and it is your responsibility to check for updates. Your continued access denotes your acceptance and agreement to all the Terms and Conditions.

All intellectual property rights, including copyright, in the content displayed on IYA ('Content') belong to IYA.

IYA and the Content may only be used for your personal, non-commercial use. For this purpose alone you may retrieve and display the Content on a computer screen, except for this, you agree not to download, copy, reproduce, modify, store, archive, show in public, redistribute or commercially exploit in any way any part of the Content without the prior written permission of IYA. You agree not to use the Content for any illegal or improper purpose, nor for any purpose which might infringe the rights of others or which might harass or cause inconvenience or distress to any person.

While all reasonable care is taken, we do not guarantee the accuracy, completeness, timeliness, performance or fitness for any particular purpose of IYA and the Content nor do we endorse or accept any responsibility for any views, advice, recommendations or opinions expressed on IYA or any website to which we link.

You hereby acknowledge that you are physically fit to participate in the classes and are aware that in participating in the physical activities shown on IYA, there is a risk or possibility of injury or death and you explicitly and voluntarily accept these inherent risks. You should not participate in any of the physical activities shown on IYA if you are suffering from any illness. If you are pregnant or under medication, you should seek the advice of a qualified medical practitioner before participating in the classes. If in doubt as to your suitability, always consult your qualified medical practitioner. It is your responsibility to ensure that you do not perform any activity which exceeds your limits or capabilities. And you hereby acknowledge that you understand and voluntarily accept the risks of injury involved in participating in the physical activities on IYA to the fullest extent permitted by applicable laws, you hereby agree that none of IYA and its employees shall be liable in contract, tort (including without limitation negligence), pre-contract or other representations or otherwise out of or in connection with your participation in the physical activities available on IYA, for any claims, demands, damages, economic losses (including without limitation, loss of revenues, profits, contracts, business or anticipated savings), loss of goodwill or reputation, or special or indirect consequential losses in any case.

AY and its employees shall not be liable whatsoever for any loss or damage in respect of any bodily injuries, illness or death however caused or incurred arising out or in any way connected with but not limited to your use of IYA.

You hereby agree to defend, fully indemnify on demand and hold harmless all of the IYA Parties  from and against all liabilities, claims, expenses, damages and losses including legal fees (on an indemnity basis) which IYA may suffer arising from any breach of these terms and conditions by you, or in connection with any act, omission, default, negligence or conduct of you or your guest, or in connection with any other liabilities arising out of your participation in the physical activities shown on IYA. This obligation to indemnify the IYA Parties shall survive the termination of the Terms and Conditions.

IYA expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement, with respect to IYA and the content thereon.

By accessing and using IYA you consent to the collection and use of your personal information. By accessing IYA you agree to accept that these Terms are governed by and construed in accordance with the laws of Hong Kong. You also accept the exclusive jurisdiction of the Court in relation to any dispute that may arise in connection with these. Terms or your use of IYA or arising in any way from the Content.

International Yoga Academy and its accredited organisation  reserves every right to change the Terms & Conditions of the online and onsite teacher training courses, classes, workshops, retreats, from time to time without prior notice.

International Yoga Academy and its accredited organisation  reserves every right to change the Classes, timings or instructors without prior notice

International Yoga Academy and its accredited organisation  reserves every right to revise the course fees and other administrative fees from time to time without prior notice.

Waiver and Release Member fully understands that he/she is engaging in physical exercise including the use of exercise facilities and instructions by the center personnel, which may cause injury to him/her. 

Member hereby warrants, represents and agrees that he/she has no physical disability, impairment, or ailment preventing him/her from engaging in any exercise activity, or that will detrimental to his/her health, safety, comfort or physical condition, or that of others. 

Member is advised to consult a physician regarding his/her ability to participate in physical activities and/or use of International Yoga Academy equipment and facilities and the physical activities undertaken at International Yoga Academy equipment and facilities imposes physical demands upon him/ her. 

Member hereby agree to waive all claims or rights he/she might otherwise have against the center including the right to sue the center, its employees or agents, for any injuries or claims aforesaid. Member has carefully read this waiver and release and fully understands this is a release of any and all future claims against the center for any injury or risk of injury resulting from activities while attending the class.

 Member further agree to release the center from any liability for any loss or theft of personal property. 

By this product, the member acknowledges his/her understanding and acceptance of the rights and obligations. Such Rules and Guidelines are posted and/or otherwise available at all International Yoga Academy locations. International Yoga Academy reserves the right to amend its Rules and Guidelines from time to time and where appropriate. Member shall ask a Membership Consultant for clarification of any question or concerns prior to signing this Agreement I have read and agreed to be bound by the Terms and Conditions Of Membership herein and below.

All monies paid are non-refundable. Member / Guardian / Co-signer’s Acknowledgement: Member/Guardian/Co-signer acknowledges that he/she has reviewed and read the terms and conditions set forth herein and accepts this Agreement as a legally binding contract, and all the rights and obligations set forth herein will be in force from the date of purchasing this package and he/she has the legal age and capacity and is wilfully entering into this Agreement. The package sessions shall expire at the end of the period stated in the product details page. Any sessions not used by the expiry date may not be used or redeemed. No refund of any payment made shall be given to any member under any circumstances.

Non-transferability of membership: Membership cannot be transferred, sold or assigned to any one. Member also cannot loan or sell or assign their membership card to anyone else. Private classes, workshops and special events may not be transferred or assigned to any one else.

Governing Law: This Agreement is governed by the laws of the Special Administrative Region of Hong Kong Entire Agreement: This Agreement constitutes the entire and exclusive agreement between the parties. Any promises, representations, understanding and/or agreements pertaining directly or indirectly to this Agreement, which is not contained herein, are hereby waived. If any particular provision of this Agreement is invalid, the same shall not affect the other provisions hereof.
